Testimony/comments were given by Roanne Seeley, RN and William Luce, Director of Auburn Adult Education. Elaine Briggs also read comments submitted by Janet Kalman, Director of Biddeford Adult Education and Richard Erb, CEO of Maine Health Care Association. The 180 hours cannot go into effect until the Board votes on it at its next meeting in March, 2009. The vote will depend on a review of testimony from hearing and written comment through Dec. 14th. IF the vote is to go forward, then the rule still has to be reviewed by AG's office. Rule would be in effect 5 days after it is filed with Secretary of State. If the AG's office is able to look at it fairly promptly - my best guess would be mid to late April. However, I did hear what was said last Thursday - and that the preference would be to make the rule effective at a "logical" starting point for classes, such as Sept. 1st or something like that. That could be added to the rule. * Is there going to be a summary of what the comments were and/or questions from that hearing that is obtainable for us to look over? Eventually there will be a summary of comments available. In fact, I provide that to the Board at its March meeting so that they will be informed re all testimony & comment. * When will the new CNA curriculum be available and when will it go into effect? Ginny has been collating the CNA Curriculum... Hope to have it soon. Revised CNA Curriculum could go into effect as soon as we can put it out since that did not require a rule change. I've saved the a blank version of the skills checklist (as an excel document) on the hand-held and transferred that information onto my laptop. Sometimes it seems like it takes time away from clinical work to keep updating it, but a friend of mine said that using the hand-held during clinicals modeled for my students that technology (and documentation) is part of the work, not a separate task. I am liable to testify in court to defend my work. So the following comes from my training and resources which will be listed. Expert witness- "One who is qualified by the court, based on education, experience, employment, publications, or research to render an opinion on certain facts where the knowledge is beyond that of a judge or jury; one who has special knowledge of the subject about which he or she is to testify." (Lynch, 2006, p. 698) "An expert witness can be held liable for testimony that deviates from the standard of care appropriate for their profession."(Lynch, p.466) Fact Witness- A witness to the actual events or occurrences observed" (Lynch, 2006,p. 698) this witness must have first hand knowledge of a particular event and can testify to "things that were heard, seen, touched, tasted or smelled and may give an opinion related to those things perceived by his/her senses." (Lynch, p. 459). The following qualifications for an expert witness have been adapted from Forensic Nursing by Virginia Lynch (2006, p.463) To establish the qualifications of an expert witness you may be asked by the judge or whoever is verifying you qualify for this: 1.Describe your current position and background as a nurse (and as a CNA instructor). How long have you been an RN (CNA instructor) and in what areas have you practiced? 2.How long have you been working as a nurse (CNA instructor)? and what education have you had to prepare for this specialty? 3.What continuing education have you had in your specialty? 4.What professional organizations do you belong to? 5.Are you certified in your field 6.Have you published any material in your field? 7.How do you do your job as an instructor-step by step (what do you teach and how?) 8.What equipment do you use, do you train your students to use, how does it work and why is it used? 9.Describe any other technical information and procedures you use or instruct in your classes. 10.Have you appeared as an expert witness in court before? 11.Are you appearing for the defense or the prosecution? Insist on meeting with the attorney who has called you and find out what he will ask and how he will support you during a cross examination which will try very hard to prove you are not qualified to answer the questions. My suggestions- Find out which side you are being called to testify for. Find out specifically why you are being called as a witness-what are you testifying to? Be very sure of your information, (if called because of misuse of a piece of equipment-do you know how it works, why it is used, what can go wrong, how someone could have a problem with it, how could someone misuse it and what risks are there to the patient or person on whom it is used? Know the standards of care not only for an RN in the State of Maine, as set by the American Nurses Association, but by the training given as a CNA trainer.
