On November 13th at the OSA Provider Day someone in session G - Engaging Retailers and Bar Owners to Affect Price and Promotions- asked the following question on their evaluation form: "What is the liability for a restaurant with a BYOB policy? (They don't have a full license.) How do the laws affect them?"
It's a great question -- below are the links to the 4 sections in title 28-A (which is liquor law) that pertain specifically to the "byob" policy (referred to as bottle clubs).
Title 28-A Chapter 7
28-A §161. Bottle clubs <http://www.mainelegislature.org/legis/statutes/28-A/title28-Asec161.html>
28-A §161-B. Local approval of bottle clubs <http://www.mainelegislature.org/legis/statutes/28-A/title28-Asec161-B.html>
28-A §162. Local authority for operation of bottle clubs <http://www.mainelegislature.org/legis/statutes/28-A/title28-Asec162.html>
28-A §163. B.Y.O.B. function permit <http://www.mainelegislature.org/legis/statutes/28-A/title28-Asec163.html>
