More Questions and Answers about Medicare's oxygen benefit are available on-line. Q. How does Medicare pay for oxygen and oxygen equipment? A. Medicare pays suppliers a monthly fee for furnishing all medically necessary oxygen and oxygen equipment, including accessories and supplies like tubing or a mouthpiece. Assuming that you have no unmet Part B deductible, Medicare pays 80 percent of the allowed amount and you pay 20 percent of the allowed payment amount. After 36 months of continuous use, Medicare stops making rental payments for the oxygen equipment, but you will continue to get the oxygen equipment, accessories, and supplies from the same supplier at no charge until the end of the reasonable useful lifetime of the oxygen equipment (currently 5 years after the date that the equipment was delivered to you). At the end of the equipment's reasonable useful lifetime, the supplier can pick up the equipment and you can get new equipment if it is determined that you still have a medical need for oxygen. When you get the new equipment, Medicare starts a new 36 month rental payment period. If you get liquid or gaseous oxygen delivered in tanks or cylinders, your supplier must continue to deliver replacement tanks or cylinders after the 36 month rental period ends, and Medicare will continue to pay for delivery of oxygen contents in these tanks and cylinders. In response, MaineCare clinical staff offers the following. Interpretation of the term "loss of function" and "risk (of) loss of limb" varies from case to case and requires clinical interpretation. The following guidelines must be used in that interpretation: 1) The loss of function or threat of loss of limb must be substantial. Conditions such as diabetes, peripheral vascular disease, or chronic venous insufficiency must be considered in considering that loss of function or threat of loss of limb. 2) Other factors to consider include: ? Loss or substantial threat to the ability to ambulate effectively ? Loss or substantial threat to the ability to work ? There are no leave days for the clinical/treatment portion of the service. * The facility is responsible to accurately track the number of leave days used by each resident * If the 30-day leave limit has expired, discharge is not mandatory by MaineCare * MaineCare cannot require a facility to hold a bed when a member's leave days have expired. The provider must make sure they follow Licensing guidelines for discharge. * The Provider must decide if they will hold the bed without payment * If the Provider decides to hold the bed without payment and not discharge, no paperwork is sent to Office of Elder Services (OES) * If the provider decides to discharge the member and not hold the bed, then the provider must send discharge paperwork to OES * If the provider discharged a member, the bill to MaineCare should show a discharge date * When the provider bills for month of admission, the claim should show the admission date * Follow the normal rules for cost of care decisions based on the living situation of the member prior to their admission. Whether a cost of care is collected, or not, depends on where the member resided during the month. * When a member's leave days are exhausted, then there would be no payment made by MaineCare for any additional leave days.
